Can my employer see my personal trips in a mileage app? Not in an app you install yourself and send claims from. With Fuelshine, the app records your drives on your own phone, you tag each trip Business or Personal, and you choose what goes into the report you send. Below: how that works, what privacy law says in Canada and the US, and three questions to ask before you install any mileage app.

Drive your own car for work? Fuelshine logs every trip automatically, you tag each one Business or Personal, and you send only what you choose. Free to start on iPhone and Android, no credit card needed.

Can my employer see where I drive?

Three different things get mixed up in this question, and each has its own answer.

  • What the app records. An automatic mileage app records your drives in the background on your phone, so you don't forget a work trip. That means personal drives are logged on your phone too.

  • What you send. You decide what leaves your phone. With Fuelshine you tag each trip Business or Personal before you export, and you choose what goes into the report you send to your employer.

  • What your employer tracks on its own. If your company installs its own tracking tool, that is a different setup, and workplace privacy rules about notice and consent may apply. An app you install yourself, on your own phone, for your own claims is not that.

So for an app you install yourself, your employer sees the claim you hand over, not a live map of your day.

Three questions to ask before you install any mileage app

Question

What a good answer looks like

Whose account is it?

Yours, on your phone. Not a company login you can't leave.

What can my employer see?

Only the claim or report you choose to send, and the privacy policy says so.

Can I mark a trip personal?

Yes, one tap per trip, before anything is sent.

If an app can't answer all three in plain words, keep looking. Fuelshine's answers: it is your own app on your own phone, you tag each trip Business or Personal before you export, and you choose what goes into the report you send. Check the app's privacy policy for the full detail on what it stores.

What privacy law says in Canada and the US

This is general information, not legal advice, and the rules differ by province and state.

  • Canada. The Office of the Privacy Commissioner of Canada looked at employee GPS tracking in a 2006 finding. It accepted some uses, such as running a more efficient service, but cautioned against using location data to monitor workers day to day. Which law applies to you depends on your province and whether your employer is federally regulated.

  • United States. There is no single federal rule on employer GPS tracking, and some states add their own. According to law firm Littler's summary of state location-tracking laws, New Jersey requires notice before tracking an employee's location, even in a personal vehicle, and Illinois and Michigan require the employee's consent to track their own vehicle.

In plain words: in many places an employer that wants to track your location has to tell you first, and sometimes get your consent. Handing over a claim you chose to send is a different thing.

What to send your employer, and what to keep

For a reimbursement claim, your employer needs the business trips only: the date, where you started and finished, the distance, and the reason for the trip. Your personal drives and your regular commute stay out of it. Tag them Personal and leave them out of the report.

A line you can forward to HR

Not sure how to bring it up? Copy this and change it to sound like you:

I've started logging my work drives in an app on my own phone. I tag each trip Business or Personal and send you only the business ones, with dates and distances, so my claims are complete and you don't have to chase me for a log.

It is about getting your own claims paid, so it is an easy yes.

Mileage app privacy: common questions

Can my employer see my personal trips?

Not through an app you install yourself, unless you choose to send them. With Fuelshine you tag each trip Business or Personal before you export, and you choose what goes into the report you send.

Does a mileage tracker track personal trips?

Automatic trackers record your drives in the background so you don't miss a work trip, which means personal drives are logged on your phone as well. What matters is that you can tag them Personal and that you control what leaves your phone. Fuelshine works that way.

Can my employer track my location with a mileage app?

Not with an app you install yourself and send claims from. Your employer sees the claim you send, not a live map of your day. If your employer runs its own tracking tool, privacy rules on notice and consent may apply.

Is it legal for my employer to track my location?

It depends on where you live and how the tracking is done. In Canada, the Privacy Commissioner has accepted employee GPS tracking for some purposes but cautioned against using it to monitor workers continuously. In the US there is no single federal rule, and some states require notice or consent. This is general information, not legal advice.

What should I send my employer for mileage reimbursement?

The business trips only: date, start and end, distance and the reason for each trip. Keep personal drives and your regular commute out of the claim.
