FUELSHINE MILEAGE TRACKER: TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By downloading, installing, registering, or using Fuelshine (the "Application," "Service," "Platform," or "App"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("ToS" or "Terms"), along with our Privacy Policy and any other policies referenced herein.

If you do not agree to these Terms, do not use Fuelshine.

These Terms apply to:

  • Fuelshine mobile application (iOS, Android)

  • Fuelshine web dashboard (www.getfuelshine.com)

  • Fuelshine REST API (for third-party integrations)

  • Fuelshine team/fleet management features

  • All related services, content, and features

 

2. SERVICE DESCRIPTION

2.1 What Fuelshine Does

Fuelshine is a mileage tracking and fuel efficiency application that collects, processes, and analyzes vehicle telematics data to provide:

  • Automatic trip logging via GPS and On-Board Diagnostics (OBD)

  • Real-time fuel consumption insights and eco-driving coaching

  • Tax-compliant mileage records for CRA (Canada) and IRS (USA) deductions

  • Vehicle health monitoring and maintenance alerts

  • Fleet management tools for businesses managing multiple vehicles

  • Insurance telematics integration for usage-based insurance programs

  • EcoPoints rewards program (may vary by region)

  • Custom reporting and data export in multiple formats

2.2 What Fuelshine Does NOT Do

Fuelshine is NOT:

  • ❌ A GPS navigation app (use Waze, Google Maps, Apple Maps)

  • ❌ A vehicle control system (cannot lock/unlock, start/stop your car)

  • ❌ Replacement for professional vehicle maintenance services

  • ❌ Tax or legal advice provider (always consult a professional accountant)

  • ❌ Insurance policy provider (we do not sell or manage insurance)

  • ❌ Financial advisor (we do not provide financial planning services)

  • ❌ Emergency roadside assistance service (though we may partner with providers)

 

3. ELIGIBILITY & ACCOUNT REGISTRATION

3.1 Age Requirements

You must be at least 18 years old to use Fuelshine (16 in some jurisdictions with parental consent). If you're under 18:

  • Obtain parent/guardian consent before creating an account

  • Parent/guardian must review and accept these Terms

  • We may request proof of parental consent

  • We may suspend your account if age verification fails

3.2 Account Registration

To use Fuelshine, you must:

  1. Create an account with:

    • Valid email address

    • Strong password (minimum 8 characters, numbers + letters recommended)

    • Driver's License information (for tax compliance features)

    • Valid vehicle registration details

    • Billing/payment information (for paid plans)

  2. Provide accurate information:

    • False or misleading information may result in account suspension

    • You are responsible for keeping information current

    • Update your profile if details change (address, license expiration, vehicle ownership)

  3. Enable two-factor authentication (2FA):

    • Available in Settings → Security

    • Strongly recommended to prevent unauthorized access

    • We may require 2FA for sensitive actions (payment changes, data deletion)

  4. Accept liability:

    • You are responsible for all activity on your account

    • Do not share your password with anyone

    • Notify us immediately of unauthorized access

4. SUBSCRIPTION & PAYMENT TERMS

4.1 Pricing & Plans

Pricing subject to change: We may update prices with 30 days' notice. Existing subscriptions continue at current price until renewal.

4.2 Payment Processing

Fuelshine uses Stripe and Square for secure payment processing.

Payment methods accepted:

  • Credit card (Visa, Mastercard, American Express, Discover)

  • Debit card

  • Apple Pay (iOS)

  • Google Pay (Android)

  • PayPal (where available)

Your payment information:

  • Never stored on Fuelshine servers

  • Tokenized and encrypted by Stripe/Square

  • Subject to PCI-DSS compliance

  • You can update payment method anytime in Settings → Billing

4.3 Billing & Charges

How billing works:

  1. Charges occur on the same date each month/year (your billing cycle date)

  2. You receive an invoice via email before each charge

  3. Failed charges are retried automatically (up to 3 attempts)

  4. Unpaid accounts may be suspended

Recurring billing:

  • You authorize automatic recurring charges

  • You can cancel anytime (cancellation effective at end of current billing period)

  • Cancellation does NOT provide refunds for current period

Taxes & fees:

  • Prices shown may not include applicable taxes (GST/HST in Canada, sales tax in US, VAT in EU)

  • You are responsible for all applicable taxes

  • Taxes are calculated and collected at checkout

  • B2B customers may provide tax ID for exemption

4.4 Refunds & Cancellation

Refund policy:

  • 7-day money-back guarantee: If you cancel within 7 days of purchase, we refund your payment in full

  • After 7 days: No refunds for past usage; upgrade/downgrade occurs at next billing cycle

  • Subscription cancellation: Effective at end of current billing period; no prorated refunds

  • Technical failures: If we fail to deliver services (app entirely unavailable >72 hours), partial refund considered case-by-case

How to cancel:

  1. Go to Settings → Subscription → Cancel Plan

  2. Or email billing@getfuelshine.com with "Cancellation Request" + your email

  3. Cancellation is effective immediately; you retain access through end of billing cycle

Account closure & data:

  • Canceling does NOT delete your account or data

  • To delete account entirely, see Privacy Policy Part 4

  • After account deletion, we retain data per legal retention schedule (7 years for tax records)

 

5. USER RESPONSIBILITIES & CONDUCT

5.1 Acceptable Use Policy

You agree NOT to:

Illegal Activity

  • ❌ Use Fuelshine for illegal purposes (fraud, tax evasion, money laundering, etc.)

  • ❌ Violate any federal, state, provincial, or local laws

  • ❌ Engage in activities that harm others (harassment, threats, extortion)

  • ❌ Facilitate organized crime or terrorism financing

Fraud & Deception

  • ❌ Falsify mileage, fuel, or vehicle data

  • ❌ Submit false insurance claims based on Fuelshine data

  • ❌ Use fake driver's licenses or forged government IDs

  • ❌ Create multiple accounts to game the system or avoid limits

  • ❌ Misrepresent vehicle ownership or driver identity

Data Integrity & Security

  • ❌ Hack, reverse-engineer, or modify the Fuelshine app

  • ❌ Attempt to access other users' accounts or data

  • ❌ Exploit vulnerabilities; instead, report them to security@getfuelshine.com

  • ❌ Use the app to collect others' data without consent

  • ❌ Run automated tools, bots, or scrapers against Fuelshine servers

  • ❌ Attempt to bypass rate limits, geographic restrictions, or access controls

Intellectual Property

  • ❌ Copy, modify, or redistribute Fuelshine code or features

  • ❌ Reverse-engineer the OBD data collection algorithms

  • ❌ Claim ownership of Fuelshine's intellectual property

  • ❌ Use our branding without written permission

Spam & Abuse

  • ❌ Send unsolicited messages or spam to other users

  • ❌ Post offensive, defamatory, or sexually explicit content

  • ❌ Harass, bully, or threaten other users

  • ❌ Spam customer support with irrelevant or abusive requests

5.2 Violation Consequences

If you violate these Terms:

  1. First violation: Warning + temporary feature restriction (24-72 hours)

  2. Second violation: Account suspension (7-30 days)

  3. Third or severe violation: Permanent account termination + data deletion + potential legal action

No refunds: Violations may result in forfeiture of subscription fees and balance.

Legal action: We may pursue civil and criminal claims if violations cause harm (fraud, data theft, etc.).

 

6. LIABILITY DISCLAIMERS & LIMITATIONS

6.1 "AS-IS" Service

Fuelshine is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We DO NOT warrant:

  • ✗ Accuracy: GPS coordinates may vary ±5-20 meters; OBD data may be incomplete or delayed

  • ✗ Availability: Service may be interrupted for maintenance (with 24h notice when possible)

  • ✗ Uninterrupted operation: We do not guarantee 100% uptime

  • ✗ Data security: No system is 100% secure; breach risk exists despite our protections

  • ✗ Device compatibility: We support iOS 14+ and Android 8+; older versions may not work

  • ✗ Emergency services: Fuelshine is NOT an emergency app; do not rely on it for emergencies

6.2 GPS & Location Data Limitations

GPS accuracy limitations:

  • ❌ Tunnels: GPS signal lost; location data unavailable

  • ❌ Urban canyons: Location error may be ±50-100 meters between tall buildings

  • ❌ Underground parking: GPS signal blocked

  • ❌ Bridges/overpasses: Intermittent signal loss

  • ❌ Remote areas: Sparse satellite coverage = reduced accuracy

  • ❌ Weather: Heavy clouds, rain, snow may affect accuracy

Legal implications:

  • GPS data alone is NOT sufficient for tax audits; supplement with fuel receipts, maintenance records

  • IRS Publication 587 requires "contemporaneous records" – keep receipts, photos, notes

  • Fuelshine provides corroborating evidence, not proof by itself

  • Always consult a tax professional

For insurance claims:

  • GPS data may be challenged in court; insurers may require additional evidence

  • Never fabricate data; insurance fraud is a criminal offense

  • Fuelshine is a tool to track actual driving, not generate fictional trips

6.3 OBD Data Limitations

OBD accuracy issues:

  • ❌ Manufacturer variance: Different vehicles report fuel consumption differently

  • ❌ Sensor aging: Older sensors drift; data may become less accurate over time

  • ❌ Environmental factors: Cold/hot weather affects fuel consumption readings

  • ❌ Aftermarket modifications: Custom engines/fuel systems may report inaccurately

  • ❌ Hybrid/electric vehicles: Consumption formulas may not apply; accuracy varies

  • ❌ Vehicle state: Engine idling, AC usage, tire pressure affect fuel economy

Not a diagnostic tool:

  • Diagnostic Trouble Codes (DTCs) are warnings, not diagnoses

  • Always have a professional mechanic inspect warning codes

  • Fuelshine does NOT replace professional vehicle maintenance

  • Do not ignore warning codes; do not drive unsafely

6.4 Eco-Driving Coaching Limitations

DriveSmart Score™ is NOT:

  • ✗ A substitute for driver's education

  • ✗ Guaranteed to improve fuel economy

  • ✗ A predictive model for accident risk

  • ✗ Insurance company policy on whether you qualify for discounts

Harsh braking/acceleration detection:

  • May produce false positives (e.g., emergency maneuver to avoid collision)

  • Not intended to penalize safe, defensive driving

  • Used for coaching purposes only; not for surveillance or punishment

  • Insurance companies apply their own scoring rules

7. ACCURACY & TAX COMPLIANCE DISCLAIMERS

7.1 NOT Tax or Legal Advice

IMPORTANT DISCLAIMER:

Fuelshine generates mileage logs and fuel consumption records for informational purposes only. We provide no tax advice, legal advice, or professional accounting services.

What this means:

  • We do NOT interpret tax law or regulations

  • We do NOT determine whether your mileage qualifies for deductions

  • We do NOT prepare tax returns or Form T2125 (Canada) / Schedule C (USA)

  • We do NOT represent you before the CRA or IRS

Your responsibility:

  • Consult a certified accountant or tax attorney before claiming deductions

  • Keep original fuel receipts, maintenance records, and trip notes

  • Maintain records for 6-7 years in case of CRA/IRS audit

  • Fuelshine data is supporting evidence, not legal proof by itself

7.2 CRA (Canada Revenue Agency) Compliance

What Fuelshine provides:

  • Contemporaneous mileage records (GPS timestamps)

  • Vehicle usage logs (business vs. personal)

  • Exportable data in CRA-compatible formats

  • Historical trip archive

What you MUST do:

  • Keep the original export (screenshot or CSV) alongside your tax return

  • Maintain underlying fuel receipts and maintenance invoices

  • Document the business purpose of each trip (sales calls, client visits, etc.)

  • Apply the current CRA mileage rate to calculate deduction

CRA requirements for business mileage:

  • Records must show date, kilometers driven, and purpose

  • Mileage must be for eligible business use (not commute to work)

  • Must be kept contemporaneously (not reconstructed months later)

  • Personal use must be excluded

  • Supporting documents must be retained

Fuelshine limitation:

  • We cannot determine if your trips qualify as business under CRA rules

  • We track WHERE you went, not WHY (that's your job to document)

  • A trip to a client's office might be business; a trip to a personal friend's house is not

7.3 IRS (Internal Revenue Service) Compliance

What Fuelshine provides:

  • Mileage logs compliant with IRS Publication 587

  • Trip data exportable in IRS-compatible format

  • Real-time documentation (not reconstructed)

What you MUST do:

  • Maintain records showing date, odometer readings, and mileage

  • Document business purpose (client meeting, conference, etc.)

  • Show beginning and ending odometer readings per tax year

  • Deduct IRS standard mileage rate (or actual expenses, not both)

  • Retain all supporting documents for at least 3-7 years

IRS rules:

  • Business miles are deductible; commuting miles are NOT

  • You must have contemporaneous written records (Fuelshine qualifies)

  • A diary or log alone is not sufficient; you need corroborating evidence (receipts, calendars)

  • Self-employed, employees, and business owners have different rules

7.4 What Happens in a Tax Audit

If the CRA or IRS audits your mileage deductions:

  1. They will request your trip records

  2. You provide Fuelshine export + fuel receipts + maintenance records

  3. Auditor compares your claims to:

    • Actual fuel purchases (receipt dates/amounts)

    • Vehicle maintenance history

    • Mileage vs. fuel consumption (does it add up?)

    • Business vs. personal trip patterns

  4. Fuelshine's role:

    • Provides GPS data showing real trips

    • Shows timestamps and distances

    • Can be challenged if data seems fabricated (all business trips, no personal)

    • Supports credibility if data is consistent and detailed

  5. Red flags that invite audits:

    • 100% business mileage (unrealistic)

    • Round numbers (500 miles per trip, always)

    • Trips only on weekdays (personal trips hidden?)

    • No supporting fuel receipts

    • Conflicting data (claims 5,000 miles but purchased 20 gallons fuel)

Fuelshine protection:

  • We cannot guarantee acceptance by tax authorities

  • We provide tools for honest record-keeping

  • We have no control over tax audits or disputes

  • Any audit outcomes are between you and the tax authority

 

8. INSURANCE & TELEMATICS DISCLAIMERS

8.1 NOT Insurance

Fuelshine does NOT provide, sell, or underwrite insurance policies.

If you're interested in insurance:

  • Contact your current insurer about usage-based insurance (UBI)

  • Or contact our insurance partners directly (we do not arrange policies)

  • Review their privacy policies and terms independently

8.2 Insurance Integration Limitations

How insurance integration works:

  1. You opt-in to share Fuelshine data with insurers

  2. Insurers receive your DriveSmart Score™ and telematics summary

  3. Insurers apply their own scoring models

  4. Insurers may offer discounts (typically 10-30%)

What Fuelshine does NOT control:

  • ✗ Insurance premium calculation (that's entirely the insurer's decision)

  • ✗ Policy approval or denial (insurer decides)

  • ✗ Premium discount eligibility (insurer's rules, not ours)

  • ✗ Policy cancellation or non-renewal (insurer's decision)

  • ✗ Claims adjudication (insurer decides whether to pay)

What Fuelshine CAN'T guarantee:

  • We cannot promise you'll get a discount

  • We cannot prevent premium increases

  • We cannot override insurer decisions

  • We cannot guarantee accuracy of our telematics data for insurance purposes

  • Discontinuing Fuelshine does NOT prevent insurers from acting on data already shared

8.3 DriveSmart Score™ Limitations

What it measures:

  • Harsh acceleration/braking frequency

  • Speeding violations

  • Time spent idling

  • Safe following distance

  • Collision event frequency

What it does NOT measure:

  • ✗ Overall driving skill

  • ✗ Likelihood of accidents

  • ✗ Violation of traffic laws (we don't check licenses)

  • ✗ Professional driver certification

  • ✗ Insurance risk in all contexts

Score usage:

  • Insurance companies may adjust scoring for their own models

  • A high DriveSmart Score does NOT guarantee insurance discounts

  • A low score may trigger premium increase or non-renewal

  • Some insurers ignore telematics entirely

Disputes:

  • If you disagree with DriveSmart Score, we can review the data

  • But we cannot override the score or remove it from your record

  • Insurers may have their own data sources

9. FLEET MANAGEMENT & EMPLOYER FEATURES

9.1 Fleet Manager Responsibilities

If you manage a fleet account (employer, fleet operator, etc.):

You are responsible for:

  • Obtaining driver consent before adding them to fleet management

  • Communicating data collection and privacy practices to drivers

  • Complying with employment laws regarding employee monitoring

  • Providing access to drivers' own data

  • Establishing clear policies on data use and discipline

What fleet managers CAN see:

  • Real-time vehicle locations

  • Trip routes and duration

  • Fuel consumption and DriveSmart Score

  • Alerts (harsh braking, speeding, geofence breach)

  • Idle time and active hours

What fleet managers CANNOT see:

  • ✗ Driver personal messages or communications

  • ✗ Personal trips (with privacy mode enabled)

  • ✗ Payment information

  • ✗ Support tickets or personal settings

  • ✗ Home location (if privacy mode enabled)

9.2 Driver Privacy in Fleet Mode

Drivers retain privacy for:

  • Trips marked "Personal" (hidden from manager; shows as "Personal Trip")

  • Home and personal locations (with privacy mode enabled)

  • Personal settings and communications

  • Data unrelated to vehicle operation

Drivers should know:

  • Employers can see real-time location during work hours

  • Harsh braking and speeding events are logged (not just quantity, but specific incidents)

  • Idle time and engine run time are monitored

  • Some privacy features may not be available in enterprise plans

 

9.3 No Waiver of Employment Laws

These Terms do NOT:

  • Override local employment laws

  • Permit illegal surveillance or discrimination

  • Waive employee privacy rights

  • Excuse harassment or retaliation based on telematics data

  • Allow discipline based solely on Fuelshine data without investigation

You must comply with:

  • Canada: PIPEDA, provincial privacy laws, employment standards

  • USA: State employment laws, federal privacy laws, union contracts

  • EU: GDPR, local employment law

  • Others: Local labor and privacy regulations

 

10. DATA ACCURACY & CORRECTION

10.1 User-Generated Data

You are responsible for the accuracy of data you submit:

  • Driver information

  • Vehicle registration

  • Trip categorization

  • Odometer readings (if manual entry)

  • Mileage rate settings

Incorrect data may result in:

  • Inaccurate tax deductions (your liability)

  • Insurance claim denials

  • Fleet management alerts based on false data

To correct data:

  1. Edit in-app (for current settings and future trips)

  2. Contact support@getfuelshine.com with past data corrections

  3. Request data amendment per Privacy Policy Part 4.2

10.2 System-Generated Data

Fuelshine provides data "as-is" from GPS, OBD, and device sensors.

Limitations:

  • GPS accuracy varies (±5-20 meters under ideal conditions)

  • OBD data reflects vehicle sensor readings, not independent verification

  • Timestamps may have latency (especially in background mode)

  • Data may be incomplete if connection drops

You acknowledge:

  • System data is best-effort, not guaranteed

  • You review and correct Fuelshine suggestions before submitting

  • You do NOT rely solely on automated data for critical decisions (tax deductions, insurance claims)

11. INTELLECTUAL PROPERTY

11.1 Fuelshine's IP

Fuelshine owns:

  • All software code, algorithms, and design elements

  • Trademarks: "Fuelshine," "DriveSmart Score™," "EcoPoints™"

  • Databases and data compilations

  • Documentation and help materials

  • Improvements and modifications developed by Fuelshine

You may NOT:

  • Copy, modify, or adapt the app

  • Reverse-engineer or decompile the code

  • Create derivative works

  • Use our brademarks without permission

  • Claim ownership of Fuelshine features

11.2 Your Data Ownership

You own:

  • Your personal data (email, phone, address)

  • Trip records you create

  • Mileage and fuel logs

  • Photos and documents you upload

You grant Fuelshine:

  • License to store, process, and analyze your data for service delivery

  • Right to create aggregated/anonymized reports

  • Right to use your data for product improvement (with anonymization)

  • Right to share telematics data with partners (per Privacy Policy)

You do NOT own:

  • Fuelshine's insights, algorithms, or scoring models

  • Compiled data from multiple users

  • Anonymized analytics

 

12. THIRD-PARTY INTEGRATIONS & LINKS

12.1 Third-Party Services

Fuelshine may integrate with third-party services:

  • Payment processors (Stripe, Square)

  • Insurance partners (Belairdirect, Wawanesa, State Farm, etc.)

  • Analytics providers (PostHog, Mixpanel)

  • Cloud infrastructure (AWS, Google Cloud)

  • Fuel price APIs (GasBuddy, etc.)

Fuelshine is NOT responsible for:

  • Third-party service availability or quality

  • Third-party privacy practices (review their policies)

  • Third-party security breaches

  • Service interruptions caused by third parties

  • Disputes with third parties

12.2 External Links

Fuelshine may link to third-party websites:

  • Vehicle manufacturer sites

  • Insurance company websites

  • Fuel price tracking services

  • News sites

  • Vehicle registration authorities

Disclaimers:

  • We do not endorse these sites or their content

  • We are not responsible for their accuracy, security, or privacy

  • Their terms and privacy policies apply, not ours

  • Use at your own risk

 

13. LIMITATION OF LIABILITY

13.1 Liability Cap

To the maximum extent permitted by law:

Fuelshine's total liability to you is LIMITED TO:

  • Option 1: The amount you paid for Fuelshine services in the past 12 months, OR

  • Option 2: $100 USD/CAD

Whichever is LOWER.

This cap applies to:

  • ✗ Lost profits or revenue

  • ✗ Lost data or documents

  • ✗ Emotional distress

  • ✗ Wrongful termination claims

  • ✗ Tax audit liabilities

  • ✗ Insurance claim denials

  • ✗ Indirect, incidental, or consequential damages

13.2 Exceptions to Liability Cap

We ARE liable (without cap) for:

  • Gross negligence or willful misconduct

  • Data breaches caused by our negligence

  • Violations of privacy laws

  • Fraud or intentional misrepresentation

  • Death or personal injury

 

14. INDEMNIFICATION

You agree to indemnify (defend and pay for) Fuelshine if you:

  • Violate these Terms or applicable laws

  • Use Fuelshine illegally (fraud, evasion, hacking)

  • Infringe on others' intellectual property rights

  • Cause harm to other users

  • Make false claims (tax fraud, insurance fraud)

  • Fail to keep your password secure and someone breaches your account

This means you pay for:

  • Legal fees

  • Settlements and judgments

  • Regulatory fines (if caused by your actions)

  • Harm to third parties

 

15. DISPUTE RESOLUTION

15.1 Informal Resolution (Mandatory First Step)

Before pursuing any legal action:

  1. Contact support@getfuelshine.com with detailed complaint

  2. Provide: account email, issue description, requested resolution, supporting documents

  3. Fuelshine responds within 30 days

  4. Good-faith negotiation for 60 days

15.2 Regional Dispute Procedures

🇨🇦 Canada (Brampton, Ontario Jurisdiction)

If informal resolution fails:

Option A: Mediation (Recommended)

  • Mutually agree on a neutral mediator

  • Share costs equally

  • Session held in Ontario (virtual acceptable)

  • Mediator helps negotiate settlement

  • If mediation fails, proceed to option B

Option B: Arbitration (User Choice)

  • Single arbitrator arbitration under JAMS/AAA rules

  • Location: Toronto, Ontario

  • Cost: Split equally (Fuelshine pays arbitrator fees)

  • Decision is binding; limited appeal rights

  • OR proceed to Option C (court)

Option C: Court (User Choice)

  • You can sue in Ontario Superior Court

  • Or in small claims court if claim <$35,000

  • Governed by Ontario law

  • Fuelshine's registered address: [TO BE ADDED]

🇺🇸 USA (Multi-State Jurisdiction)

If informal resolution fails:

Option A: Mediation (Recommended)

  • Mutually agree on mediator (JAMS, AAA preferred)

  • Virtual or in-person mediation

  • Share costs

  • 30-day mediation period

Option B: Arbitration (User Choice)

  • Federal Arbitration Act (FAA) applies

  • Single arbitrator, JAMS/AAA rules

  • Location: Virtual or mutually agreed (user can request phone/video)

  • Cost: Fuelshine pays arbitrator fees

  • Decision binding; limited appeal

  • OR you can pursue court instead

Option C: Court (User Choice)

  • Small claims: If claim <$5,000, can sue in small claims court (no arbitration)

  • Civil litigation: If claim ≥$5,000, can opt out of arbitration in writing within 30 days

  • Jurisdiction: State where you reside or where we operate

  • Governing law: Laws of your state (e.g., California, New York)

  • You can sue in Brazilian courts

  • Governing law: Brazilian law

For other disputes:

  • Arbitration available (if both parties consent)

  • Or court proceedings in Brazil

🇦🇺 Australia (Privacy Act Jurisdiction)

If informal resolution fails:

For privacy disputes:

  • No arbitration (Privacy Act protections include court access)

  • File complaint with Office of the Australian Information Commissioner (OAIC)

  • Can sue in Australian courts

For other disputes:

  • Arbitration (if agreed) or court

  • Governing law: Australian law

15.3 Class Actions & Collective Actions

You agree:

  • ✗ You cannot join a class action lawsuit

  • ✗ You cannot pursue a collective action with other users

  • ✗ Each dispute is handled individually (via arbitration or court)

  • ✗ No class-wide claims even if others have similar issues

Exception: Some jurisdictions (EU, Canada, Australia) may not permit waiving class actions; local law overrides this clause.

17. TERMINATION & ACCOUNT SUSPENSION

17.1 Termination by You

You can terminate your account anytime:

  1. Go to Settings → Account → Delete Account

  2. Or email privacy@getfuelshine.com with "Account Deletion Request"

  3. 30-day grace period before permanent deletion

  4. Remaining subscription balance: NOT refunded

17.2 Termination by Fuelshine

We can suspend or terminate your account if:

  • Violation of Terms: Fraud, hacking, illegal activity

  • Non-payment: 30 days overdue on subscription

  • Inactivity: No login for 12 months + failed contact attempts

  • Abuse: Harassment, threats, violation of acceptable use policy

  • Legal requirement: Court order, regulatory demand

  • Technical: Service discontinued in your region

Notice: We provide 30 days' notice except in cases of:

  • Imminent harm or illegal activity (immediate termination)

  • Severe violations (3-7 day notice)

  • Non-payment (payment reminder, then 7-day notice)

17.3 What Happens After Termination

Data retention:

  • Active account data deleted after 30-day grace period

  • Legal hold data retained per privacy law (7 years for tax records)

  • Payment records retained (7 years for accounting)

Services ceases:

  • You lose access to trip data, fleet management, features

  • API integrations stop

  • Insurance data sharing stops

  • Data exports are no longer available

 

18. CHANGES TO TERMS

18.1 Updates & Modifications

Fuelshine may update these Terms anytime.

How we notify:

  • Major changes: In-app notification + email (30 days before effective date)

  • Minor clarifications: Posted on website; no separate notification

  • Emergency changes: Effective immediately (legal requirement)

18.2 Your Acceptance

By continuing to use Fuelshine after we publish changes, you accept the new Terms.

If you disagree:

  • Stop using the service

  • Delete your account per Section 17.1

  • No refund for pre-change subscription usage

 

19. ENTIRE AGREEMENT

These Terms, along with the Privacy Policy and Data Processing Agreement (if applicable), constitute the entire agreement between you and Fuelshine.

Previous agreements:

  • Any prior terms of service are superseded and no longer apply

  • Side agreements (emails, verbal promises) do not override these Terms

  • If conflicts exist, these Terms control

 

20. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable by a court:

  • That provision is severed

  • All other provisions remain in effect

  • Exception: Class action waiver is core to our agreement; if invalid, entire agreement may be void

22. ACKNOWLEDGMENTS

By creating a Fuelshine account, you acknowledge:

✓ You are at least 18 years old (or have parental consent if 16-17)
✓ You have read and understand these Terms of Service
✓ You agree to abide by all provisions herein
✓ You understand the limitations and disclaimers, including:

  • Fuelshine is not professional tax, legal, or insurance advice

  • GPS/OBD accuracy limitations

  • Liability is capped

  • Some disputes go to arbitration (USA) or courts (others)
    ✓ You accept responsibility for maintaining account security
    ✓ You agree to indemnify Fuelshine for violations

 

23. SPECIAL PROVISIONS BY JURISDICTION

23.1 EU/EEA Consumers

If you're in the EU/EEA, additional consumer protections apply:

  • Right to 14-day withdrawal from purchase (not just 7 days)

  • Mandatory liability for product defects

  • Cannot fully waive statutory rights

  • Arbitration only if GDPR-compliant

23.2 California Residents (CCPA)

  • You have right to know, delete, correct, and opt out (see Privacy Policy)

  • Cannot discriminate for exercising privacy rights

  • Accessibility requirements for website/app apply

23.3 Canadian Residents (PIPEDA)

  • Personal information access/correction rights apply

  • Breach notification required within reasonable timeframe

  • Class action waiver may not be enforceable under Canadian law

 

APPENDIX A: SERVICE LEVEL AGREEMENT (SLA)

Available for Business & Enterprise plans only.

Uptime commitment: 99.5% monthly (30 minutes downtime allowed)
Downtime refund: 5% monthly credit per 0.1% below 99.5%
Maintenance windows: Announced 48 hours in advance, outside business hours

 

APPENDIX B: API TERMS (For Developers)

Fuelshine REST API is available to Business & Enterprise customers.

API limitations:

  • Rate limit: 1,000 requests/hour per app

  • Data retention: Real-time data only; historical data via data export

  • No re-sale: Cannot resell Fuelshine data to third parties

  • Monitoring: Excessive rate limiting may trigger account review

API abuse: Rate limiting, API key revocation, account termination
